At The Ashmore Law Firm, we understand that divorce is more than just a legal process—it’s a life transition that affects every area of your world. Whether your situation is straightforward or complex, our Dallas-based team is here to guide you with experience, clarity, and compassion.

Understanding Divorce In Texas

Texas is a no-fault divorce state, which means you don’t have to prove wrongdoing to file for divorce. You can simply state that the marriage has become insupportable due to conflict that can’t be resolved. However, fault—such as infidelity or cruelty—can still play a role when it comes to dividing assets or determining spousal support.

To file for divorce in Texas, you or your spouse must have lived in the state for at least six months, and in the county where you’re filing for at least 90 days.

What To Expect

Every divorce is unique, but most involve decisions on the following:

  • Property and Debt Division
Texas follows community property laws. That means most assets and debts acquired during the marriage are considered jointly owned and must be divided in a just and right manner. This doesn’t always mean 50/50—fairness depends on many factors, including income disparity, fault, and future needs.
  • Child Custody and Support
If children are involved, the court will prioritize the best interests of the child. Our team can help you navigate conservatorship (custody), possession and access (visitation), and ensure child support is calculated and structured appropriately.
  • Spousal Support (Alimony)
Spousal maintenance isn’t guaranteed in Texas, but it may apply depending on the length of the marriage, each spouse’s financial situation, and whether one spouse is unable to earn enough to meet basic needs.
  • Mediation and Trial
Many Texas divorces are resolved through mediation. But if an agreement can’t be reached, we’re fully prepared to advocate for you in court.
